China to Better Protect Rights of People Suing Govt Bodies

The Supreme People's Court announced new regulations Thursday to better protect the rights and interests of people in lawsuits against government bodies.

The Supreme People's Court announced new regulations Thursday to better protect the rights and interests of people in lawsuits against government bodies.

According to the regulations, only cross-examined evidence at court hearings can be accepted as the basis for a verdict. Other legal reforms include improving the system of burden of proof in courtroom debate, clarifying litigants' duties to provide evidence,procedures of attestation and protection of attestors and plaintiffs.

Vice-president of Supreme People's Court Li Guoguang said at a news briefing on Thursday that the regulations embodied the principle of protecting the underdog in pursuit of the spirit of equality before the law.

"Many of the articles also follow the rules of the World Trade Organization, of which China has just become a member, and are consistent with Chinese laws just amended accordingly," Li said.

China introduced the Administrative Procedure law in 1991. Since then 730,000 cases have been brought before the people's courts across the country, with government departments as the defendants.

Ordinary people win 30-35 percent of these lawsuits against government bodies, statistics show.
