China Lays out Strict Rules for Audio-visual Businesses

A violator-banning system will be put into practice in Chinese audio-visual market. The units, individuals who've ever been administered with the cancellation or revocation of business license due to serious violation of the law and regulation are prohibited to engage in any business of audio-visual products within a timeframe of 10 years from the day of being punished.

A violator-banning system will be put into practice in Chinese audio-visual market. The units, individuals who've ever been administered with the cancellation or revocation of business license due to serious violation of the law and regulation are prohibited to engage in any business of audio-visual products within a timeframe of 10 years from the day of being punished.

And at the same time their names will be entered into the "national databank for units and individuals banned to access audio-visual market" and made open to the public.

The units and individuals into the "Black List" include those being criminally sanctioned due to their illegal business and activities in audio-visual products; those engaged without approval in wholesale, retail, leasing, showing, doing chain business and electronic business of audio-visual products; those units and their legal persona or executives and individuals who've been revoked the license for audio-visual business and some other units and persons in serious violation of the law and regulation.

The Ministry of Culture will set up a "national databank for units and individuals banned to access audio-visual market" in http://av.ccnt.com.cn, practicing a two-level administration.

That is to say, the cultural administration (bureau) of province, autonomous regions and municipalities under the direct jurisdiction of the central government will submit according to the user's name and secret code provided by the ministry the relevant materials to the rear databank. And when examined and approved by the ministry's Department of Culture they will be logged onto the net for checkup.

As learned the regulation is worked out by the Ministry of Culture in accordance with the "Regulation on the Control of Audio-visual Products". The Article 47 of the "Regulation on the Control of Audio-visual Products" has it stipulated that unit in violation of the regulation and being administered with the revocation of business license, its legal persona or executive will be banned to be the legal persona or executive of the unit engaged in publication, making, copying, import, wholesale, retail and let of audio-visual products within 10 years from the very day he receives the punishment.

The individual, who is engaged in retail, let or show of audio-visual products and in violation of the law and regulation, will be prohibited to do the business within 10 years time from the very day the business license is revoked.

According to the regulation, cultural administrations at all levels should first of all check up the databank when dealing with the approval of the applications for audio-visual products businesses. Any unit or individual listed in the databank will not be permitted by any cultural sector to set up unit and engage in audio-visual business nor should the application for the appointment as legal persona, general manager or executive be approved to the person in concern. No approval will be given to any individual on the list to apply for and engage in audio-visual business and activities.

Persons concerned are of the opinion that the "Black List" system is an important measure in regulating the business order and promoting the building up of honesty of the audio-visual market by resorting to sophisticated scientific technology.

This will be good for further smashing the illegal activities as smuggling, piracy of audio-visual products, dealing a heavy blow to unlawful dealers in this field and finally bringing the audio-visual market into a good order.
