Three people have been jailed and one given a deferred sentence for negligence at a kindergarten where a fire killed 13 children on June 5 last year.

The blaze at the Jiangxi Radio and TV Arts Kindergarten in Jiangxi Province, east China, was caused by mosquito-repellent incense which was left burning under beds in the children's dormitory while no teachers or nurses were on duty.

The victims aged three and four mostly died of suffocation.

The Nanchang Intermediate People's Court sentenced teacher YangHuizhen, who lit the incense, to three years in prison.

Nurse Wu Zhiying, who was away from her post for nearly an hourwhen the disaster happened, was sentenced to five years in jail.

Ni Yongchen, director of the kindergarten, and Liu Yuenan, headof the kindergarten, were both sentenced to three years in jail and Liu was given the sentence with three years' reprieve.

Both were found guilty of failing to carefully execute their duties and establish fire control and security measures, and of employing untrained people, like Wu Zhiying.

The four defendants appealed to the Nanchang Intermediate People's Court after the first trial at the Xihu District People'sCourt on May 9. The intermediate court rejected the appeal, but deferred Liu's sentence according to his involvement in the case.
