United Airlines Being Sued in Beijing

Father and son by the name of Tan in Haidian District of Beijing sued the United Airlines for delaying their boarding the plane, therefore causing the economic losses.

According to the news of Dec 25, 2002 from Beijing, father and son by the name of Tan in Haidian District of Beijing sued the United Airlines for delaying their boarding the plane, therefore causing the economic losses. So far the People's Court of Chaoyang District of Beijing has already accepted to handle the case. Though the UA is now in the course of being reorganized due to its bankruptcy the hearing of the case won't be affected by the background as experts put it.

Mr. Tan of a certain technological company in Beijing prosecuted that on the 1st of last September Mr. Tan and his son, due to business needs, were to go on board the UA flight for Portland in USA. When they finished all frontier checkup procedure they were obstructed by the UA working personnel for no reason at all from boarding the plane. And so they failed to board the plane and had to change another flight, resulting in delaying their arrival at the destination and lost the business opportunity.

Entrusted by his company as signer, the plaintiff was going there to sign a contract with other company. But because of the hindrance of the defendant the entrusted lost the benefits they should be able to get and also due to this Mr. Tan suffered a fine of RMB 100,000 yuan from his company. Therefore, Mr. Tan holds that the action of the defendant has seriously violated and damaged his personal benefit. Though he made many a time of representations he received no reply from the defendant. And so he brought up the action to the court, demanding that the defendant make an open apology and compensate him the loss of air-tickets, the economic losses and the more expenses entailed from the change of the flight and other expenses, a total of RMB 153,750 yuan.

As the reporter learned from the UA office in Beijing, the office so far hasn't received any notice from the court. For the moment the UA Beijing business is in normal order. As learned the UA Group's reorganization is being carried out smoothly after it applied for bankrupt protection. The series of proceedings brought forward the first day after its application for bankrupt protection have already obtained the approval of the US court handling the case of bankruptcy. This will ensure that the UA can have a normal operation in the course of being reorganized and guarantee the flight service quality, salary and welfare of its working personnel as well as its cooperation with the clients.

According to Li Jiang, Lawyer of the Zhongchao Lawyer's Firm in Beijing, the hearing of the case won't be affected due to the bankrupt reorganization of the UA. Should the case be ruled entering into the bankruptcy proceeding and the enterprise to bear the compensation when the court heard the case the creditor shall be able to realize his own rights according to different cases. Should the enterprise applied for bankruptcy be still in the protection period yet able to carry out civil act it has to bear by its own the liability of compensation. Should a liquidation group be already set up the rights and liabilities of the enterprise shall be borne by the liquidation group in a uniformed way. Should the enterprise applied for bankruptcy has a reorganizer the reorganizer shall be requested to take up the civil liability.
