Two Chinese Sentenced for Plotting Overthrow of State Power

The Intermediate People's Court of Liaoyang City in northeast China's Liaoning Province Friday sentenced Yao Fuxin and Xiao Yunliang, two former industrial workers, to prison terms of seven and four years respectively on charges of attempting to overthrow state power.

According to the first instance ruling, Yao, a former steel rolling worker in Liaoyang, and Xiao, a former ferro-alloy worker in Liaoyang, took an active part in plotting to set up the Liaoning provincial branch of the so-called "China Democratic Party," which aimed at overthrowing state power and the socialist system.

Despite admonition by the local public security department on many occasions, Yao and Xiao showed no sign of repentance, but continued to create disturbances, spread rumors and instigated local people to break into the Liaoyang City government departments, seriously disturbing their normal work order.

The court ruled that evidence proved the two were guilty of crimes of subversion in accordance with articles 105 and 106 of the Criminal Law.

The Liaoyang City Procuratorate lodged legal proceedings on Dec.27, 2002 and the local people's court heard the case on Jan. 15 this year.

Yao and Xiao exercised the right to defense in the court hearing. Their attorney pleaded on their behalf. The accused and their relatives were among the people of various social sectors who attended the first ruling.
