China to Regulate Transfer of Land-use Rights

China plans to regulate the transfer of land-use rights as of August 1 of this year in a bid to curb irregularities in management of land resources, according to the Ministry of Land and Resources.

China plans to regulate the transfer of land-use rights as of August 1 of this year in a bid to curb irregularities in management of land resources, according to the Ministry of Land and Resources.

The ministry on Tuesday issued a regulation on negotiated transfer of the use-right of state-owned land, the first of its kind in China to regulate negotiated transfer of land-use rights.

The regulation, effective on August 1, was designed to regulatethe market order of land-use rights and curb corruption.

According to the regulation, the transfer of the use rights of state-owned land should only be made through negotiated agreement if they are not covered by related laws and regulations which stipulate the land-use rights should be transferred through publicbidding and other ways.

But the use rights for land to be used for commercial purposes,such as trade and retailing, tourism, entertainment and commercialresidential projects, should not be transferred through negotiation.

The regulation also sets the standard for determining minimum prices for land-use rights, and the time limit for making public transfer of land-use rights through agreements.
