Innocent former jailbirds get state compensation

Two former prisoners, who were found innocent after they had served ten years each in jail are to receive state compensation, according to judgments made by the Higher People's Court of Hainan Province.

Two former prisoners, who were found innocent after they had served ten years each in jail are to receive state compensation, according to judgments made by the Higher People's Court of Hainan Province.

Huang Yaquan will get over 157,000 yuan (about 18,900 US dollars) for the 3,181 days he lost his freedom, while Huang Shengyu is expected to obtain over 159,000 yuan for his 3,217 daysin jail and in custody.

According to the court, the pair are villagers from Wanning City, Hainan. They were detained on August 22, 1993, and formally arrested on November 8, by local police, for suspected involvement in a robbery.

On March 20, they were both sentenced to death with a two-year reprieve by the Intermediate People's Court of Hainan Province, and on July 17, the Higher People's Court of Hainan supported the sentencing, rejecting appeals by the two.

The arrest of the real culprits prompted the Higher People's Court to re-try the case on August 12 this year. One day later, the duo were released on parole. On September 1, the court set the two innocent men free on the spot.

On September 26, the pair applied for state compensation to the Higher People's Court. The court turned down their requests for 314,000 yuan and 318,000 yuan, respectively.

The state compensation was then paid in accordance with a resolution made by the Supreme People's Court this year, which says that the state will pay 49.8 yuan (about six US dollars) per day spent in prison by those who have been wrongly imprisoned.
