Beijing Municipal Supreme Court promulgated recently the Guiding Principle over the Confirmation of Compensation on Copyright Violation, which was the first specialized regulation handling the cases of copyright violation.

The guiding principle has totally 35 items, touching upon various issues such as the confirmation of violation compensation, the principle and ways of compensation, the compensation of spiritual violation as well as the confirmation of the amount of copyright violation compensation, etc.

More importantly, the guiding principle made certain new regulations on the compensation of copyright spiritual violation, i.e. for those grave circumstances of the violation of copyright-related personal right and performer's personal right, the ordinary measures of suspension of violation, elimination of ill effects and the extension of formal apology could not console the spiritual damage of plaintiffs, the accused should pay the plaintiffs spiritual damage consolation money, which is supposed to be ranging from 2,000 to 50,000 yuan.
