As learned from the Ministry of Personnel a decision jointly issued by the Ministry and the State Administration of Industry and Commerce says that foreign companies, enterprises and other economic organizations engaged in HR intermediary or related services must form joint ventures with Chinese HR intermediaries in order to launch services in China.
Meanwhile those which set up Chinese-foreign HR intermediary agencies should meet the requirements provided in Chinese laws on Chinese-foreign joint ventures. They should gain the approval from personnel and administrative departments at the provincial level where the planned agency resides, apply for license and report to the Ministry of Personnel for the record. They must also go through other procedures in accordance with relevant regulations.
According to the Ministry the decision made certain modifications to the part of Regulations on Human Resources Market, which relates to administrative license. Applications can be submitted in the form of letter, telegram, telex, fax, EDE and e-mail etc. Period to accept applications has also been reduced to 20 days from previous 30 days. Once the personnel and administrative department approves the application it should issue and deliver the license to the applicant within 10 days.
