A Chinese company, Henan Shuaike Pharmaceutical Co., Ltd. lodged a lawsuit against Warner Health Products, an American pharmaceutical company, for trademark infringement.
In its indictment submitted to Beijing First Intermediate People's Court Shuaike accused Warner of putting Shuaike's registered trademark, which was protected by the law, on Warner's Shark Capsules which Warner claimed to be a cure. Shuaike said the General Administration of Industry and Commerce had ruled that Warner's behavior was trade infringement.
Shuaike filed its petition to the court that Warner stop the infringement, apologize for its behavior, eliminate the adverse market impact and compensate for the losses. Shuaike also claimed that Warner's exclusive agent in the Chinese mainland, a biotech company in Beijing, should also be held responsible.
