The East African Court of Justice (EACJ) has ruled that the regional law societies can challenge the community treaty amendments in the regional court. The ruling was made on Thursday in Arusha where the regional court seats, according to reports reaching here on Friday. The ruling came as a response to a lawsuit filed on May 18 this year jointly by the East Africa Law Society, the Law Society of Kenya, the Tanganyika Law Society, the Uganda Law Society and the Zanzibar Law Society.
The law societies are challenging the legality of the fact that the EAC Treaty had been amended in 14 days instead of 120 days as provided under Article 150 of the treaty itself. These law societies have sought to stop the EAC partner states from further implementing the amendments to the EAC Treaty that they commenced in December last year. The East African Court of Justice has urged all parties to the lawsuit to argue the case in full so that they can reach one final decision in the issue.
