Influential case should be judged by combined court
The regulation under discussion also requires that influential criminal, civil, or administrative cases should be tried by the combined court of the judge and people''s jurors.
What''s an influential case then? The Supreme Court proposed two types:
One, the case has a great social impact in the area of jurisdiction. The court should decide whether it is influential or not according to the specific situation. For example, it must be determined how much the people care about the case or whether it involves the interests of the general public.
Two, there are certain standards for an influential case. For example, the following are all considered to be influential cases: a case relevant to public interest; local society is concerned about the case; a case involving many parties; an aggravated conflict between two parties; an important administrative case; a case relevant to the protection of a minor; or a case with a serious social impact.
In addition, the regulation also states that defendants in the first trial of criminal cases, the plaintiff or defendant of civil cases, and the plaintiff of administrative cases, should be sentenced by the combined court of people''s jurors and professional judges.
