China Issues Anti-Subsidization Code

China published the Anti-Subsidization Regulations on Import Goods Tuesday, in an effort tomaintain order in foreign trade and fair competition in the world market.

Effective date
According to the State Council's No. 329 Decree, signed by Premier Zhu Rongji, the statute was approved at the 46th executive meeting of the cabinet on October 31, 2001 and will come into force on January 1, 2002.

Content
The statute is composed of 58 articles in 6 chapters.

Investigations will be carried out and necessary anti-subsidization measures adopted on imported goods that have received government subsidies and, consequently, have brought about substantial impairment to local industries, according to the statute.

China may adopt corresponding measures, based on specific circumstances, against any country or region that has adopted anti-subsidization measures against China, the code says.

Departments responsible
The Ministry of Foreign Trade and Economic Cooperation (MOFTEC) is responsible for negotiating, briefing and resolving matters concerning the disputes, while MOFTEC and the State Economic and Trade Commission are authorized to work out concrete procedural methods for the implementation of the statute.
